For authors who may be interested to know: 
 
Pitch-Black LLC is moving toward legal dissolution. At that time, all contracts with any parties will become null and void.

Pitch-Black retains only two-active novella contracts: one with Nathan Meyer for American Assassin (with myself as contractual co-author) and one with Steven Shrewsbury for Whore of Jericho. Upon legal dissolution of the company, the rights to these works will revert to the authors.

 
Meanwhile, PB has ceased all marketing efforts, notified our distributor of our plans to shut down, cancelled all forthcoming projects, dismantled our websites and acquisitions staff. The CEO has resigned, and I will be contacting each of contributors with pending contracts or projects personally as soon as time allows.
 
General info regarding authors and projects:  

As pertains to Flashing Swords: the contracts for the current stories may be considered invalid because the relationship between Flashing Swords E-zine and Pitch-Black has been severed. Flashing Swords E-zine has not received its stipend for 2007 from Pitch-Black LLC.
 
As current Editor-in-Chief of FS E-zine I will release all submitted materials to their authors unless there are renegotiations for the story to be published when FS revives at some later date. 

As pertains to Lords of Swords 2. Because the Lords of Swords 2 project has been cancelled *all* contracts for this project are null and void even without the legal dissolution of Pitch-Black, as the contracts stipulated that the stories were to be published in the "Lords of Swords 2" anthology and this anthology will not be published. Most of the contracts for the stories were never counter-signed anyway and so are not legally valid.

As pertains the Flashing Swords E-zine stories. These contracts, also, were never counter-signed and so are not legally binding.

As pertains to all other current submisisons: all stories and materials are the free and clear property of their authors.

I will be sending individual responses to submitters as soon as time permits and ask that if any of you have further concerns or questions you email me or send a PM and I will do my best to answer.

Real sorry to hear about it going down. Pitch-Black and Flashing Swords seemed like solid rocks in the ever-shifting tide of small-press ventures. You always had a strong vision for how to make it work.

Man, funny you should say that, Nicholas. I just heard that a man in Glenwood, IN, about 8 minutes away, won $2 million dollars. My wife plays the lotto, so I'm in the running, but I just thought how damn lucky that would be. And then immediately started thinking of a traditional print run publishing company...yeah, it'd be nice if one of us won.

What would really be nice is to hit one of those big Powerballs and win 10s of millions. Then as a publisher, not even worry about profit, but just make it the best publishing quality possible- pay the writers and artists well, slipcase, leatherbound, frontispiece, gilded edges, plenty of lush interior paintings, and of course the greatest stories to be found.

Thanks, buddy. Small Press publishing is a rough business -- even solid rocks sometimes are turned into little pebbles ;-) by the torrential downpour!

What you have just described is a recurring daydream fantasy that often plays through my mind on the long drive to work...
